Star Book Publishers offers personal print-on-demand, self-publishing services that enable customers to design, create, layout, print, and publish professional-quality books and publications, including digital editions (each referred to as a “Book” in these Terms and Conditions, as well as in our Privacy Policy and Legal Information). In addition, Star Book Publishers provides print-on-demand services for professional-quality wall art prints and related products (“Wall Art”). Visitors to our website may also register to become members of the Star Book Publishers community.

The services provided by Star Book Publishers (“Star Book Publishers,” “us,” or “we”) include the website, as well as any other features, content, or services introduced from time to time (collectively, the “Services”).

This Terms and Conditions Agreement (“Agreement”) defines the legally binding terms governing your use of our Services. By using the Services, you agree to comply with this Agreement, whether you are a “Visitor” (browsing the Website) or a “Member” (registered with an Account). The term “User” refers to both Visitors and Members.

BY USING THE WEBSITE AND SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND THE STAR BOOK PUBLISHERS PRIVACY POLICY, WHICH IS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE WEBSITE OR SERVICES.

You represent and warrant that you are authorized to enter into this Agreement for yourself and/or on behalf of the entity you represent.

Additional Terms

Certain Services may require you to accept additional terms or content. Unless otherwise specified, such additional terms are incorporated into this Agreement. In the event of a conflict between this Agreement and the terms specific to a Service, the latter shall control with respect to that Service.

Amendments

Star Book Publishers may modify this Agreement at any time. Such modifications shall take effect:

For new Users, immediately upon posting on the Website.

For existing Users, thirty (30) days after posting on the Website.

For Members, if material changes occur, thirty (30) days after notification by e-mail. Continued use of the Services constitutes acceptance of the updated Agreement. If you do not accept the changes, you must discontinue using the Services.

1. Eligibility

By using the Services, you represent and warrant that: (a) all registration information you provide is truthful and accurate; (b) you will maintain accurate information; (c) you are in the U.S. and at least thirteen (13) years old, or in the EU and at least sixteen (16) years old; and (d) your use of the Services complies with applicable laws and regulations.

Accounts may be deleted without notice if you are found to be underage as defined above.

2. Term

This Agreement remains in effect as long as you use the Services or are a Member. You may cancel your Account at any time by contacting Star Book Publishers Customer Support. Star Book Publishers may terminate your membership at any time and for any reason, effective upon notice to your registered e-mail address.

Termination results in the deletion of your profile and uploaded content. Star Book Publishers will not be liable for such termination or data loss. Sections 8 through 26 of this Agreement shall survive termination.

3. Fees

Star Book Publishers reserves the right to charge for Services and adjust fees at its discretion by posting updates on the Website. By using the Services, you agree to pay all applicable fees as listed on the Website.

4. Conditions of Sale

4.1 Eligibility; Credit Card Terms

To order Books, Wall Art, or other products, you must be at least eighteen (18) years old or the applicable age of majority in your jurisdiction. A valid credit card (VISA, MasterCard, American Express, or other accepted issuer) and billing details are required for purchases, including: (i) name on the card, (ii) card type, (iii) expiration date, (iv) billing address, and (v) any required security codes.

Cash, checks, and other payment methods are not accepted at this time. By providing payment details, you authorize Star Book Publishers to charge all fees due. You are responsible for maintaining updated billing information. Star Book Publishers may change pricing and billing methods at any time by posting updates on the Website or sending e-mail notification.

4.2 Fees and Charges

You agree to pay all fees, taxes, and charges associated with your purchases at the rates in effect at the time of order. Star Book Publishers may automatically charge applicable sales, use, or value-added taxes, unless valid exemption documentation is provided. For international deliveries, you may be subject to customs duties or import taxes. These charges are your responsibility, and customs regulations vary by country. You are considered the importer of record and must comply with all applicable laws and regulations.

4.3 Disputes

Any billing disputes must be submitted to Star Book Publishers within seven (7) days of the charge appearing on your credit card statement. Failure to notify us within this period constitutes waiver of the dispute. All disputes should be directed to Star Book Publishers Customer Service at 418 Broadway #4313, Albany, NY 12207, or via Order Support. If payment is not received from your card issuer, you remain liable for the outstanding balance.

4.4 Refunds

Refund requests will be reviewed in cases where you believe your Book is not being created according to your specifications or the requirements outlined during your registration process, whether via email or phone with our support team. The exact refund percentage will be determined based on the amount of work already completed on your project, as well as your written or verbal approval of the product(s) or service(s) paid for.

4.5 Returns

All sales of Books, Wall Art, and other products are subject to Star Book Publishers’ current return policies, as posted on the Website.

4.6 Gift Cards

By purchasing or using Gift Cards, you agree to the applicable terms and conditions governing Star Book Publishers’ Gift Cards, which are incorporated by reference and may be updated by Star Book Publishers at its discretion.

5. Order Acceptance Policy

Receipt of an electronic or other form of order confirmation does not constitute Star Book Publishers’ acceptance of your order, nor does it confirm an offer to sell. Star Book Publishers reserves the right, at any time after receiving your order, to accept or decline it for any reason. We also reserve the right to fulfill fewer items than ordered, without prior notice. Your order will be considered accepted only upon delivery of the products you purchased. Additional verification or information may be required before an order is accepted.

6. Duties, Taxes, and Import Fees

Some countries may impose customs fees, import duties, or taxes on our products and other merchandise. Due to customs processing, delivery times may be longer than estimated at checkout. All local duties, customs, and taxes must be paid by the recipient at the time of delivery.

7. Passwords and Account Security

When registering as a Member, you must choose a username and password. You are solely responsible for maintaining the confidentiality of your password and for all activity under your Account. You agree not to use another Member’s account credentials at any time. If you suspect unauthorized use of your Account, you must notify Star Book Publishers immediately. You are fully responsible for all activities linked to your Account.

8. Your Content for Books, Wall Art, and Other Products

8.1 Definitions

“Content” refers to all material, including text, design templates, images, photos, video, sounds, works of authorship, and other files. “Book Content” includes Content you use in Books, submit to Star Book Publishers for Books or print services, or contribute to other Members’ Books. “Wall Art Content” refers to Content you use in Wall Art or other products, submit to Star Book Publishers for production, or contribute to the Wall Art of other Members. Star Book Publishers does not claim ownership of your Book Content, Wall Art Content, or any other Content you provide.

8.2 Ownership of Your Content

You represent and warrant that: (i) you own, or have the rights to grant, the licenses outlined in this section for your Book Content, Wall Art Content, or other product Content; and (ii) your Content does not infringe upon the rights of any individual or entity, including privacy, publicity, or copyright rights.

8.3 Submissions

8.3.1 Book Content: You may submit your Book Content either through Star Book Publishers’ online tools or by providing us with a PDF that meets the required specifications.
8.3.2 Wall Art Content: You may submit your Wall Art Content through Star Book Publishers’ tools or in a format that meets our production requirements.

8.4 Licenses

To enable Star Book Publishers to provide its Services, you grant the following licenses:

8.4.1 License to Print: You grant Star Book Publishers a non-exclusive, worldwide, fully-paid, royalty-free license to reproduce and distribute your Book Content, Wall Art Content, or other product Content for the purposes of printing, fulfilling your orders, or fulfilling authorized purchases by others. We may retain electronic files of your Content to process future orders and keep archival copies.

8.4.2 License for Optional Features: If you choose to use optional features, such as making your Book searchable, shareable, or viewable in preview, you grant Star Book Publishers a license to reproduce, distribute, publicly display, and otherwise use your designated Book(s), Book Content, and related data as necessary to provide such features.

8.5 ISBN Numbers and Publisher Status

Star Book Publishers may provide tools allowing you to include an International Standard Book Number (“ISBN”) in your Book(s). You may either acquire an ISBN through Star Book Publishers or use your own. Regardless of the method, Star Book Publishers is not the publisher of your Book(s). You acknowledge and agree that you are solely the publisher of your Book(s) and bear full responsibility for their publication and distribution.

9. Star Book Publishers Content

The Services include content owned by Star Book Publishers and its licensors (“Star Book Publishers Content”). Star Book Publishers and its licensors (including Users) retain all proprietary rights in both the Star Book Publishers Content and the Services. Star Book Publishers grants you a limited, revocable, and non-sublicensable license to reproduce and publicly display the Star Book Publishers Content solely for personal use connected to accessing the Website and Services. Except as stated in the previous sentence, you may not reproduce, distribute, publicly perform (including by digital audio transmission), publicly display, create derivative works from, or otherwise use the Star Book Publishers Content.

10. Other Content

Subject to Section 8.4.2 above, you hereby grant Star Book Publishers an irrevocable, perpetual, nonexclusive, fully-paid, royalty-free license (with the right to sublicense) to use, reproduce, create derivative works, distribute, and publicly display any Content you upload, post, email, transmit, or otherwise make available on the Website, except for your Book Content, Wall Art Content, or product Content (“Other Content”). Examples include public profile details, social media correspondences with Star Book Publishers, or public information about a Book uploaded through the Website. Star Book Publishers may use Other Content internally, externally, in marketing materials, and to improve service and support.

11. Your Content and Activity

You are solely responsible for all Book Content, Wall Art Content, product content, and Other Content posted through your Account on the Services (including third-party Content received), as well as any email or materials included in Books, Wall Art, or other products submitted by you for print services, and for your interactions with other Users. You agree that Star Book Publishers retains the right to impose limits on storage and archiving of such data, including but not limited to deleting data after inactivity or charging fees for extended storage periods.

11.1 Prohibited Content

YOU MAY NOT INCLUDE “PUBLISHED BY STAR BOOK PUBLISHERS,” “STAR BOOK PUBLISHERS PUBLISHING,” OR ANY LANGUAGE THAT DIRECTLY OR INDIRECTLY SUGGESTS STAR BOOK PUBLISHERS IS THE PUBLISHER OF YOUR BOOK(S). You agree not to post, upload, or submit for print services any “Prohibited Content.” Prohibited Content includes Book Content, Wall Art Content, product content, or Other Content that: (i) is offensive, pornographic, or promotes racism, hatred, or violence; (ii) bullies, harasses, or advocates stalking or harassment; (iii) constitutes “spam,” “junk mail,” “chain letters,” or mass mailings; (iv) is false, misleading, obscene, defamatory, or endorses illegal activity; (v) infringes copyrights or trade secrets, such as pirated programs or music; (vi) exploits individuals under eighteen (18) sexually or violently, or solicits data from anyone under thirteen (13); (vii) teaches illegal acts, privacy violations, or malware creation; (viii) solicits passwords or personal data unlawfully; (ix) contains viruses, malware, worms, or corrupted files; (x) violates laws on exports, competition, discrimination, or advertising; (xi) involves harmful commercial activities or damages Star Book Publishers’ interests; (xii) involves harmful content affecting buyers or distributors, as determined by Star Book Publishers; or (xiii) otherwise violates this Agreement or creates liability. Prohibited third-party sales may also include: (i) summaries, workbooks, or derivative content without permission; (ii) journals, planners, or similar publications with more than 10% blank or repetitive content; (iii) imitations of popular works including covers, titles, or content; (iv) misleading or low-quality products, such as unreadable text, pixelated images, or inaccurate descriptions; (v) books priced outside fair market value; (vi) scanned books with illegible portions; or (vii) works created using artificial intelligence or automated scraping, such as content sourced from Wikipedia or public domain materials mimicking existing versions. STAR BOOK PUBLISHERS RESERVES THE RIGHT TO REFUSE TO PRINT ANY PRODUCT CONTAINING PROHIBITED CONTENT, and you agree to indemnify and hold Star Book Publishers, affiliates, officers, employees, partners, suppliers, and service providers harmless from any claims, liabilities, or expenses resulting from violations of this section.

11.2 Your Profile

Content posted in your profile may not include nudity, violence, sexually explicit material, or offensive themes. You may not upload or submit photographs of another person for print services without that individual’s prior consent.

11.3 Member Interaction

You agree not to use (a) the Services or (b) information obtained through the Services to harass, abuse, Spam, or harm others, or to contact, solicit, advertise to, or sell to any User without their prior explicit consent.

11.4 No Disruption

You agree not to: (i) cover or obscure banner advertisements on your profile or any Star Book Publishers page using HTML/CSS, scripting, or other methods; (ii) interfere with, disrupt, or impose undue burden on the Services or connected networks; or (iii) deploy automated agents, generate automated messages, or mine or strip data from the Services.

11.5 Miscellaneous

You will not attempt to impersonate another User or any individual, including Star Book Publishers employees. You agree to use the Services only in compliance with applicable laws and regulations.

11.6 Enforcement by Star Book Publishers

Star Book Publishers reserves the right (though not the obligation) to review and remove any Content that, in its sole judgment, violates this Agreement; constitutes Prohibited Content; is illegal; infringes rights; harms or endangers any User or person; or creates liability for Star Book Publishers, its affiliates, partners, suppliers, service providers, or Users. Star Book Publishers further reserves the right (without obligation) to investigate violations and act at its sole discretion, which may include removing Prohibited Content, suspending or terminating membership, reporting offenders to law enforcement, or pursuing legal action.

12. Copyright Policy

Star Book Publishers’s policy is to terminate membership privileges of Members who infringe copyright, upon receiving prompt notice from the copyright owner or its legal agent. If you believe your work has been copied, posted, or used in a Book, Wall Art, or product in a way that constitutes copyright infringement, provide our Copyright Agent with: (i) your electronic or physical signature as authorized agent of the copyright owner; (ii) description of the copyrighted work; (iii) location of infringing material on the Service; (iv) your contact details including address, phone, and email; (v) a written statement of good faith belief that the use is unauthorized; and (vi) a statement under penalty of perjury confirming accuracy and your authority to act. 13. Third Parties and Other Users

13.1 Third-Party Content

Content from other Users, advertisers, and third parties may be accessible through the Services. Because Star Book Publishers does not control such Content, you agree it is not responsible for any third-party material, including ads and information about products or services. Star Book Publishers makes no warranties as to the accuracy, quality, suitability, or currency of such Content, and assumes no liability for any objectionable, misleading, inaccurate, or unlawful material provided by Users, advertisers, or third parties.

13.2 Responsibility

Your dealings with other Users, advertisers, or third parties—including interactions, payments, and product or service delivery—are strictly between you and them. This applies equally to contributions made or received when collaborating on Books, Wall Art, or other products through the Services. You agree Star Book Publishers is not responsible for losses or damages arising from such interactions or disclosures of personal data by others. In disputes with third parties (including Users), Star Book Publishers has no duty to intervene but reserves the right to monitor disputes at its discretion.

13.3 Third-Party Links

Links to external websites or locations are provided solely for convenience and do not imply endorsement of such sites or their content. Users may also share such links within the Star Book Publishers community. Star Book Publishers has no control over, and does not review or accept responsibility for, external sites or their content. Please note that our Privacy Policy does not extend to such third-party websites.

14. Limited Warranty

14.1 Limited Warranty for Books, Wall Art, and Products

Star Book Publishers warrants that Books, Wall Art, and other products will be free of material defects in workmanship or materials, subject to minor variations across products and printing partners as noted in the Return Policy (https://www.StarBookPublishers.com/returns). Star Book Publishers’s sole obligation, and your exclusive remedy, is replacement of defective items reported via Order Support within fourteen (14) days of receipt, in accordance with the Return Policy.

14.2 Exceptions to Warranty

Star Book Publishers does not proof, edit, or modify any Content in Books, Wall Art, or products you submit for print. Therefore, the warranty excludes correcting: (a) typographical errors, grammar issues, unfinished or erroneous text; (b) low-resolution images appearing blurry in print; (c) design elements such as format, style, color, or layout; or (d) other creative decisions you make regarding Books, Wall Art, or products. ONCE CONTENT IS UPLOADED, IT CANNOT BE EDITED. You agree not to upload Book Content, Wall Art Content, or product Content unless fully proofed and ready for publishing. Star Book Publishers is not responsible for inaccurate Content, profile data, or errors caused by Users, Members, equipment, or programming. It assumes no liability for omissions, interruptions, deletions, defects, delays, communication failures, theft, destruction, or unauthorized access to User communications. Nor is it responsible for Internet or Website technical issues, including damage to computers from participation or downloads. Star Book Publishers is not liable for any loss, damage, injury, or death resulting from Services use, posted Content, or User interactions, whether online or offline.

14.3 Disclaimers

TO THE EXTENT PERMITTED BY LAW: (A) THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT FOR THE WARRANTY IN SECTION 14.1; (B) Star Book Publishers DISCLAIMS ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. SOME JURISDICTIONS RESTRICT EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF WARRANTY DURATION, SO THESE LIMITATIONS MAY NOT APPLY. THIS WARRANTY PROVIDES SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHERS THAT VARY BY JURISDICTION. 15. Limitation on Liability

TO THE MAXIMUM EXTENT PERMITTED, Star Book Publishers SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF SUCH POSSIBILITY. IN ALL EVENTS, Star Book Publishers’S LIABILITY TO YOU FOR ANY CLAIM, REGARDLESS OF FORM, SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT PAID TO Star Book Publishers IN THE SIX (6) MONTHS PRIOR TO THE CLAIM. THIS AGREEMENT DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY Star Book Publishers OR ITS EMPLOYEES OR AGENTS. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION OF LIABILITY, SO THIS MAY NOT APPLY.

16. Release

You release Star Book Publishers, its officers, employees, agents, and successors from claims, damages, losses, rights, or actions, including injuries, death, and property damage, arising directly or indirectly from interactions with Users. If you are a California resident, you waive California Civil Code Section 1542, which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

17. Indemnity

You agree to indemnify, defend, and hold harmless Star Book Publishers, its subsidiaries, affiliates, officers, agents, partners, and employees from any claim, demand, loss, liability, or expense (including attorney’s fees) asserted by any third party arising from your use of the Services in violation of this Agreement, or resulting from your breach of any term herein.

18. Electronic Communications

Communications between you and Star Book Publishers occur electronically, whether via the Website, Service use, email, or posted notices. For contractual purposes, you (a) consent to receive communications electronically; and (b) agree that all terms, disclosures, notices, and agreements sent electronically satisfy legal requirements for written communication. This provision does not affect statutory rights.

19. U.S. Export Controls

Content available through the Services is subject to United States export laws. Content may not be downloaded, exported, or re-exported in violation of such laws. By accessing or using the Content, you represent and warrant compliance with all applicable U.S. export regulations.

20. Governing Law and Arbitration

This Agreement is governed by the laws of New York, without applying conflict of laws principles that might allow another jurisdiction’s law. You and Star Book Publishers consent to the jurisdiction and venue of the state courts in New York (USA) and the federal courts in the District of New York (USA). The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Any dispute or claim (other than injunctive or equitable relief) where the award sought is under ten thousand U.S. Dollars (US$10,000.00) may be settled through binding non-appearance arbitration, chosen by the party requesting relief. Arbitration will be initiated with an established alternative dispute resolution provider (“ADR Provider”), applying its rules unless conflicting with this Agreement. The initiating party will propose an ADR Provider, and consent may not be unreasonably withheld. Rules include: a) arbitration by phone, online, or written submissions, as chosen by the initiating party; b) proceedings in English; c) no in-person appearances unless agreed; d) judgments may be entered in any competent court. Each party pays its own attorney fees and shares ADR costs equally. Star Book Publishers may still seek injunctive or equitable relief to protect intellectual property rights. Note: your jurisdiction’s laws may differ, including regulations on what may be legally bought, sold, imported, exported, or offered. You must comply with all international and domestic laws, ordinances, and regulations regarding use of Services and purchase of Books, Wall Art, or other Star Book Publishers products.

21. Relationship of Parties

You and Star Book Publishers are independent contractors. Nothing in this Agreement establishes a partnership, joint venture, agency, franchise, sales representative, or employment relationship. You have no authority to make or accept any representations or offers on behalf of Star Book Publishers. You agree not to make any statement, whether on your website, in your Book Content, on your Wall Art, or within other products, that would contradict the provisions of this section.

22. Notices

Star Book Publishers may provide any required notice under this Agreement by posting a general notice on the Website, sending an email to your registered address, or mailing written communication by first-class mail or pre-paid post to your recorded address. Notices are deemed given forty-eight (48) hours after posting or mailing (if sent by first-class mail or pre-paid post) or twelve (12) hours after sending by email. You may provide notice to Star Book Publishers, addressed to the Chief Operating Officer, deemed effective when received, by: (i) letter via confirmed facsimile to (518) 444-7790; (ii) letter delivered by a nationally recognized overnight service, or first-class postage or prepaid mail, to: Chief Operating Officer, Star Book Publishers, Inc., a division of Reischling Press, Inc. (RPI), 418 Broadway #4313, Albany, NY 12207.

23. Force Majeure

Neither party shall be liable for delay or non-performance (other than obligations to pay money) caused by events reasonably beyond its control, including but not limited to wars, revolutions, riots, hostilities, civil commotion, national emergencies, epidemics, floods, fire, earthquakes, natural disasters, explosions, embargoes, or any other “act of God.”

24. Other

This Agreement becomes binding once you use the Website or register as a Member. Together with the End User License Agreement and the Privacy Policy, which are incorporated by reference, it forms the final, complete, and exclusive agreement between you and Star Book Publishers, replacing and merging all prior discussions. If any term of this Agreement is deemed invalid or unenforceable, that provision shall be modified and interpreted to achieve its purpose as closely as possible under applicable law, while all remaining terms will remain in full effect. Star Book Publishers’ failure to exercise or enforce any right or term shall not be considered a waiver of that right or provision. Section titles in this Agreement exist only for convenience and carry no legal or contractual weight. The parties have expressly required that this Agreement be written in English. 25. Copyright/Trademark Information:

Copyright © 2010–2020, Star Book Publishers. All rights reserved. The trademarks, logos, and service marks (“Marks”) shown on the Website in connection with the Services belong to Star Book Publishers or third parties. You may not use these Marks without prior written approval from the respective owner.

26. International Provisions

26.1 United Kingdom

A third party who is not a signatory to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, though this does not affect rights or remedies otherwise available outside that Act.

26.2 Germany

Despite anything stated in Section 15, Star Book Publishers shall not be held liable for acts of simple negligence (unless such acts cause injury or death), except where they involve a breach of essential contractual obligations.

27. Cancellation of Service

27.1 Pre-Initiation Cancellations

If the project has not yet started, the Client may not cancel this Agreement without first consulting their assigned Account Manager. The Account Manager will make reasonable efforts to resolve any concerns. If no mutually acceptable resolution is reached, either party may cancel the Agreement in good faith.

27.2 Post-Initiation Cancellations

If the project has begun and work is underway, the Client shall be responsible for all expenses tied to project planning, resource allocation, and any completed deliverables up to cancellation. Additionally, a non-refundable processing and administrative fee equal to fifteen percent (15%) of the total project value will be charged to cover CRM management, account handling, and resource deployment.

27.3 Unauthorized Dispute Action

If the Client initiates a chargeback, payment dispute, or legal/financial action without first notifying and engaging with the Account Manager, such action shall be considered a material breach of this Agreement. In such cases, Star Book Publishers reserves the right to pursue all available legal remedies, including but not limited to civil proceedings for reputational and financial damages in the jurisdiction of the United States.
